Will the Courts Overturn the U.S. Presidential Election?

Current political issues in the United States are as divisive as they have been since the years after the Civil War. One of the mechanisms in the U.S. Constitution is the power that the judiciary has over the legislative and executive branches of governments in terms of deciding arguments such as the ones that have broken out over the election.

In public, many Republicans stand behind Trump, talking about how he has the right to go to court and make his case – which is certainly protected by the Constitution. Senate Majority Leader Mitch McConnell was the most pointed in his remarks, saying that the nation did not need lectures from those who had questioned the legitimacy of Trump’s election in 2020, although it is worth noting that Hillary Clinton, Trump’s opponent, had conceded defeat by this point.

In an interview with CNN, Senator John Cornyn (R-TX) said that Trump has “every right to go through the process. Right now it looks like an uphill climb for him to be sure…this could be over pretty quickly.” No substantive evidence has emerged for the sort of claims that Trump and his supporters are making, which makes judicial intervention extremely unlikely at this point in time.

Either way the court rulings end up going, the fact remains that a lot of the trust that formerly deposited in the American election process has been lost, so it might prove good for the health of the political apparatus that all measures are taken to confirm the authenticity of Biden’s victory and put the whole case to rest once and for all. After all, a clean victory is a clean victory.
